User Agreement

If you download, upload, copy or in any other way use the games " Fobos 17 " or any part thereof and (or) begin to participate in the gameplay of these games, then you confirm that you have fully read, understood, realized, agree and accept all of the User Agreement set out below , undertake to comply with it in full and bear responsibility for its violation.

This user agreement (“ Agreement ”) governs the relationship between Fobos 17 and you, the end user of one of the following games: World of Fishers   (“ User ”), hereinafter individually referred to as a “Party” and collectively as the “Parties”.

 

1. TERMS USED IN THIS AGREEMENT

1.1. Account — a User account created by the User and owned by Fobos 17, which represents a collection of data about the User stored on the Game Resources, necessary for their identification (authentication) on the Game Resources and access to their personal data, settings, purchased Additional Features, statistical indicators in the Game, as well as other similar information.

1.2. Game Features – software features of the Game beyond the basic functionality of the Game, access to which the User acquires for a fee, the amount and terms of which are determined in accordance with this Agreement. Such features include, but are not limited to, the valuables used in the Game, including in-game currency (" gold , " "silver," etc.), special in-game assets (" items," etc. ), and the User's upgraded status in the Game for a certain period (" VIP ").

1.3. The Game is one of the following interactive online computer games: World of Fishers , which is a computer program and includes Game resources, additions and updates to the Game (patches), as well as databases.

1.4. Game resources — all servers, software, portal and websites, as well as databases related to the Game, located, including on the websites https :// wof . fish   and their subdomains.

1.5. Game elements — the entire set of objects, items, elements, and methods of the gameplay (gameplay) used in the Game (except for Additional Features), access to which is provided to the User during the use of the Game on a free basis.

1.6. Game Website – the website located at http s:// wof . fish   or other Fobos 17 websites related to the Game (including all subdomains).

1.7. The client part of the Game is the software required for the User to use the Game, including the use of Additional Features, which must be installed on the User’s personal computer.

1.8. User – an individual who has the necessary legal capacity to enter into this Agreement and who is granted the right to use the Game under the terms and conditions provided for in this Agreement.

1.9. Game Rules — a document establishing the rules of participation and conduct of the User in the Game, as well as the User's liability for violating the Game Rules.

1.10. Forum Rules — a document establishing the rules of conduct for the User on the official forum of the Game (“Forum”), as well as the User’s liability for violating the Forum Rules, located at .

 

2. TERMS OF CONCLUSION OF THIS AGREEMENT

2.1. Mandatory Documents. Before participating in the Game, the User must read and accept the terms of this Agreement, as well as the terms of the following documents: Game Rules and Forum Rules (hereinafter referred to as the " Key Documents ").

The User is also obligated to accept and comply with all third-party platform rules applicable to the specific Game, including the Apple Appstore and Game Center rules, as well as the Google Play rules. Violation of such rules is considered a violation of the Key Documents.

2.2. Moment of Agreement Conclusion . This Agreement is concluded upon the User's acceptance of the terms of this Agreement and the Key Documents. Actual use of the Game by the User also constitutes acceptance of the terms of this Agreement and the Key Documents and the conclusion of this Agreement. The User undertakes to comply with the terms of this Agreement and the Key Documents from the moment the Agreement is concluded.

 

3. SUBJECT OF THE AGREEMENT

3.1. Access to the Game . In accordance with this Agreement, Fobos 17 grants the User the right to use the Game to the extent, in the manner, for the period, and within the territory specified in the Agreement, subject to the User's compliance with the terms of this Agreement.

3.2. Game Usage Procedure . The User has the right to use the Game within its basic functionality free of charge, and also to access Additional Features for a fee. The scope of rights granted to the User is defined in Section 4 of this Agreement.

3.3. Role of Fobos 17. Operation and maintenance of the Game, as well as granting the User the right to use the Game, is carried out exclusively by Fobos 17 or its authorized representatives.

3.4. Territory. Fobos 17 reserves the right, at its sole discretion, to determine the territory in which it operates the Game and provides users with access to the Game and Additional Features.

 

4. THE GAME AND ITS ADDITIONAL FEATURES

4.1. User Rights . The User has the right to use the Game and its Additional Features in the following ways:

4.1.1. Play the Game by installing it on a personal computer (PC) or other device with the required technical characteristics, or by other permitted means for the purpose of participating in the Game.

4.1.2. Participate in the Game subject to mandatory compliance with the terms of the Key Documents, for which the User has the right to: (a) create an Account under the terms and conditions set forth in this Agreement; ( use the basic software functionality of the Game to acquire and manage Game Elements free of charge; © acquire and manage Additional Features subject to payment of the fee established by Fobos 17; and (d) perform other actions permitted by Fobos 17 in the Game.

4.2. Technical conditions for participation in the Game . In order to use the Game, the User, depending on the technical features of the Game, must independently install the Game Client on a computer or other device with the required technical specifications, or access the Game website, or perform other required actions. The Game Client may be distributed by Fobos 17 and/or its authorized representatives both online and on physical media. The Game Client distributed online is provided to the User free of charge.

The User's participation in the Game is possible only in interactive (online) mode, and therefore the User must be connected to the Internet.

In some cases, particularly in some Games on the iOS and Android platforms, the User may authorize through a third-party system if this is expressly permitted in the Game.

Fobos 17 also warns that if the User loses their account password and login, Fobos 17 reserves the right not to conduct an investigation to recover the lost or forgotten login information. Fobos 17 reserves the right not to disclose the account login information. Among other things, cases in which the complete loss of the Account and all associated valuables is possible include the loss of a technical device, its password, and unauthorized modification of the operating system (jailbreaking) or software.

4.3. Restrictions. The User has no right to:

4.3. Distribute 1. for commercial or non-commercial purposes audiovisual elements, images, and other intellectual property objects present in the Game (except in cases permitted by Fobos 17).

4.3. Distribute 2. Game Elements and Additional Features for commercial or non-commercial purposes.

4.3. Transfer 3. rights to the Game, including its Additional Features, for commercial or non-commercial purposes to third parties, including by transferring the Account, concluding an agreement, or by other means.

4.3. 4 . Use the Account of another User.

4.3. Alienate 5. or otherwise transfer the Account or acquire the Account of another User, including by exchange or receipt as a gift.

4.3. Use 6. automated scripts to collect information or otherwise interact with the Game or its elements. Use a "bot"—an automated "assistant." Use any automation. All in-game actions must be performed by the User and only by them—without scripts, programs, or mechanical/semi-automated/automated "assistants." Third-party programs are prohibited; only those linked to from official sources by the FOBOS 17 developers are permitted.

4.3. Use 7. contact information of other Game Users to send unwanted information (spam).

4.3.13. Размещать в Игре вредоносные программы или ссылки, которые могут содержать или содержат вредоносные программы.

4.3.14. Размещать в Игре материалы порнографического характера или ссылки на них.

5. RESPONSIBILITIES OF "FOBOS 17"

5.1. Obligations of Phobos 17. Phobos 17 undertakes to:

5.1.1. Provide the User with the opportunity to participate in the Game under the terms and conditions set forth in this Agreement, subject to the User's compliance with this Agreement and the Key Documents.

5.1.2. Provide the User with the opportunity to purchase (download) the Client portion of the Game from the Game's website or in any other manner permitted by Fobos 17.

5.1.3. Notify the User of changes to the terms of this Agreement by publishing information on the Game's website and/or sending electronic messages to the User's email address.

6.   RIGHTS OF " FOBOS 17"

6.1.   Rights of 17 has the Fobos 17. Fobos right to:

6.1.1. At any time, unilaterally limit, expand, supplement, modify, or otherwise change the Game, including any of its elements and parts, without prior notice to the User, including by changing the Key Documents.

Modification of the Game, its elements and parts is carried out by creating and installing new parts of the software (patches), the purpose of which may be, for example, improving or changing the gameplay or adding new capabilities (features) to the Game, which may lead to the removal or suspension of access to certain Game elements.

The User understands and hereby acknowledges that these actions are an integral part of the Game creation process, and also consents to the performance of these actions by Fobos 17 without prior notice to the User.

6.1.2. Manage the Game, game processes, technical and other characteristics of Game Elements and Additional Features solely at its own discretion; suspend or change the course of the game process without prior notice to the User.

6.1.3. At any time, modify or delete any information posted by the User on the Game Resources, including the User's statements and announcements in the Game chat or on the Game Forum.

6.1.4. Restrict or terminate the User's access to the Game in accordance with the terms of this Agreement, including if the User violates the terms of this Agreement or the Key Documents. When exercising this right, Fobos 17 is not obligated to provide the User with evidence of the User's violation of the Agreement, which resulted in the User's access being terminated or restricted.

6.1.5. During gameplay, make comments to Users, warn, notify, and inform them of any non-compliance with the Key Documents or the terms of this Agreement. Users are obligated to follow Fobos 17 instructions received during gameplay.

6.1.6. At any time, completely terminate access to the Game (close the Game) or its Additional Features, taking into account the provisions of this Agreement.

 

7. FEATURES OF USING THE GAME

7.1. Legal Capacity . The User hereby confirms that they have sufficient legal capacity to enter into this Agreement. If the User is under 18 years of age or is fully or partially incapacitated under law, the User hereby confirms that they have received permission from their parents or legal guardians to enter into this Agreement in the form established by law.

7.2. Absence of Medical Contraindications . The User agrees that the Game may contain audio and/or video effects that, under certain circumstances, may exacerbate epileptic and other neurological disorders in susceptible individuals, and confirms that they do not suffer from such disorders and will not use the Game otherwise.

7.3. Reasonable Use of the Game . The User understands, accepts, and agrees that regular, prolonged (uninterrupted) use of a personal computer or other technical device may cause various physical impairments, including visual impairment, scoliosis, various forms of neuroses, and other negative effects on the body. The User guarantees that they will use the Game only for reasonable periods of time, with breaks for rest or other measures to prevent physical impairments.

7.4. "As is" Condition . The User understands and hereby agrees that Fobos 17 provides the Game on an "as is" basis and provides no warranties regarding the Game other than those expressly stated in this Agreement or applicable law.

7.5. Use of Third-Party Materials . The Game contains links to websites, programs, photographs, videos, audio, graphics, and text materials belonging to third parties. The User understands and hereby agrees that the inclusion of links to third-party websites or materials in the Game does not mean that Fobos 17 endorses, approves, or recommends such websites or materials. The User follows links to third-party websites, installs third-party software, and uses third-party materials entirely at their own risk, including while using the Game.

7.6. Legal Restrictions . The User may not use the Game if the laws of their location prohibit participation in online games or impose other restrictions, including age restrictions, on the use of such software. In this case, the User is responsible for their use of the Game.

7.7. User Materials . The User hereby understands, accepts, and agrees that they are solely responsible for any materials or other information they post in the Game, on the Game Website, the Forum, in the Game Chat, or otherwise communicate to other Users or make publicly available.

7.7. Information Dispatch. By accepting this Agreement, the User agrees to receive emails related to this game, no more than once per calendar year.

 

8. LIMITATION OF LIABILITY OF "FOBOS 17"

8.1. Disclaimer of Liability for the Actions of the User or Third Parties . Fobos 17 is not responsible for:

8.1.1. Illegal or other actions of the User and/or third parties that prevent the use of the Game or its Additional Features by other users.

8.1.2. User statements published on Game Resources. Fobos 17 is not responsible for the User's behavior in the Game and on Game Resources, including disrespectful behavior toward other users.

8.1.3. Loss by the User of the ability to access the Account created by him (loss of login, password, or other information necessary for the User to participate in the Game).

8.1.4. Incomplete, inaccurate or incorrect indication of the User’s data when creating an Account.

8.1.5. The User’s lack of access to the Internet and the quality of Internet provider services.

8.1.6. Third-party materials posted on the Game Resources or on third-party websites accessible via links from the Game Resources.

8.2. No warranties . Fobos 17 does not warrant that:

8.2.1. The Game will meet the User’s subjective requirements and expectations.

8.2.2. The gaming process on the Game Resources will be continuous, fast, without technical failures, reliable, and error-free.

8.2.3. The results that may be obtained using the Game software and database during participation in the Game and when exercising the rights to use Additional Features will be error-free and correct.

8.2.4. The quality of the gameplay, aspects of the Game, its Additional Features, as well as information obtained during the Game or when using the software and databases provided on the Game Resources, will meet the User's expectations.

8.2.5. The Game will be available for use 24 hours a day, at a certain point in time, or during a certain period.

8.3. Limitation of Liability . Fobos 17 shall not be liable for any direct or indirect damages, or lost profits, to the User or third parties resulting from:

8.3.1. use or inability to use the Game and Game resources;

8.3.2. unauthorized access by third parties to the User’s personal information, including that which is linked to the Account created by him;

8.3.3. statements or behavior of a third party in the Game or on the Game Resources.

Under any circumstances, Fobos 17's liability to the User is limited to an amount not exceeding the amount of payments received by Fobos 17 from the User prior to the occurrence of circumstances that gave rise to Fobos 17's liability.

8.4. Force Majeure . The User shall be released from liability for any failure to fulfill obligations under this Agreement, in whole or in part, if such failure is caused by force majeure, including mass riots, prohibitive actions by authorities, natural disasters, fires, catastrophes, as well as as a result of failures in telecommunications and electrical networks, the actions of malicious programs, and the dishonest actions of third parties aimed at gaining unauthorized access or disabling the software or hardware system.

 

9. USER'S RESPONSIBILITIES

9.1. User Obligations . The User is obliged to:

9.1.1. Comply with the terms of this Agreement and the Key Documents. If the User disagrees with the current Agreement, the User is obligated to cease participating in the Game, including uninstalling the Game Client.

9.1.2. At the time of creating an Account, provide accurate information.

9.1.3. Not to violate the intellectual property rights of Fobos 17 in relation to the Game or elements of the Game Resources. The User may not copy, broadcast, distribute, publish, or otherwise distribute or reproduce materials (text, graphics, audio, or video) within the Game Resources without the written consent of Fobos 17.

9.1.4. Take independent measures to ensure the security of their Account and prevent its unauthorized use by third parties. The User undertakes not to disclose or transfer to third parties their identification data that may be used for authorization (authentication) of the User.

9.1.5. Follow Fobos 17's instructions received individually or as part of a group of users in the Game, the User Support Center, the Game Website's news section, the Game Forum, and other means. Fobos 17 reserves the right to suspend, restrict, or terminate the User's access to the Game and/or Additional Features if such instructions are not followed.

9.1.6. At the request of Fobos 17 in connection with the conclusion and execution of this Agreement, confirm your personal or other data necessary to fulfill the terms of the Agreement and comply with the law.

9.1.7. Do not examine the program code, decompile, disassemble, modify the Game, or create derivative works based on the Game or its parts, except in cases where such actions are performed with the written consent of Fobos 17.

9.1.8. Compensate Fobos 17, other users of the Game and/or other third parties for any losses incurred by them in connection with the actions of the User, including in connection with the violation of this Agreement, intellectual property rights or other rights of the said persons.

9.1.9. Immediately notify Fobos 17 of any unauthorized use of the Account, hacking, or other similar actions.

9.1.10. Comply with other requirements and obligations stipulated by this Agreement and the Key Documents.

9.2. Beta Testing . If the User participates in the beta testing of the Game, the User acquires the status of a beta tester. Beta testing is conducted solely for the purpose of evaluating the Game's capabilities and identifying errors. During beta testing, the User does not receive the rights and benefits specified in the Agreement. Fobos 17 is not responsible for events occurring during beta testing. After the end of beta testing, all in-game valuables and Additional Features will be removed from Accounts (except in specially agreed cases during open beta testing). The User confirms that they are participating in beta testing at their own risk and understands that the Game may contain errors. Any in-game valuables and Additional Features may be removed at any time (except in specially agreed cases during open beta testing). Fobos 17 is not responsible for ensuring uninterrupted access to the Game. Any information obtained by the User during beta testing is confidential and will not be disclosed. To participate in beta testing, you must complete the authorization process and participate in person.

 

10. ADDITIONAL GAME FEATURES

10.1. Game Part. This section of the Agreement governs the terms and conditions for using the Additional Features of the Game. Additional Features are part of the Game, and the User may access them only through the Game. The User may use Additional Features within the limits established by Phobos 17.

The User agrees that the Game does not constitute gambling, a game of chance, a contest, or a bet. Access to the Additional Features of the Game is acquired at the User's own discretion and is not a mandatory condition for participation in the Game.

10.2. Content. By purchasing Additional Features, the User gains access to expanded Game functionality, including special features that affect the speed and quality of the User's progress in the Game, as well as other aspects of the gameplay. Fobos 17 unilaterally determines the types and content of Additional Features.

10.3. Term of Use. Access to the Additional Features of the Game is deemed granted to the User upon their transfer to the Account. Access to the Additional Features is granted to the User for the duration of this Agreement, unless otherwise provided by this Agreement or the Key Documents, or unless otherwise required by the nature of the Additional Features themselves.

The period of access to the use of a premium account is calculated from the moment a record about it is created on the Account created by the User and is valid until the expiration of the premium account validity period established by Fobos 17.

10.4. Compensation. Fobos 17 provides the User with access to Additional Features solely at the User's discretion, subject to payment of the fee established by Fobos 17. The fee amount is determined unilaterally by Fobos 17 and is indicated in-game or elsewhere. In certain cases, the payment system or payment method operator may charge a fee in addition to the fee established by Fobos 17. The User understands and hereby agrees that, in order to access Additional Features when making a payment through certain payment systems or payment methods, they may be required to make a payment in an amount different from that established by Fobos 17.

The fee amount indicated by Fobos 17 on the Premium Store web pages or other resources may be expressed in two or more different currencies. The User understands and hereby agrees that (a) when paying through certain payment systems or payment methods, the operator of such systems or payment methods may apply a currency exchange rate different from that used by Fobos 17; ( as a consequence of paragraph (a), the amount billed to the User may differ from the amount indicated by Fobos 17.

Access to the Additional Features of the Game is granted to the User only upon full payment. Until confirmation of full payment is received, Fobos 17 reserves the right to withhold or limit the availability of Additional Features to the User.

10.5. Payment Procedure and Methods. Payments for the rights to use Additional Features are made by the User by transferring funds to Fobos 17 through payment systems and payment methods supported by Fobos 17. The list of payment systems and methods available for payment is determined unilaterally by Fobos 17 and is indicated on the Premium Store website or otherwise.

When making payments for the right to use Additional Features, the User undertakes to follow the instructions of the relevant payment systems and payment methods selected by the User, as well as the payment terms established by Fobos 17. The right to use Additional Features is granted to the User only upon the proper execution of the payment instructions and terms.

The user undertakes to provide accurate information when making payments. The user bears all risks of negative consequences associated with providing incorrect information when making payments.

If, when making a payment, due to a technical error, the User is granted access to Additional Features in a volume that clearly does not correspond to the funds paid, the User is obligated to immediately notify Fobos 17. Fobos 17 will make every effort to provide the User with access to Additional Features in the volume paid for.

For questions regarding the rules and procedures for using payment systems and methods, the User must contact the operators of their chosen payment systems and methods directly. Fobos 17 may, where available, advise the User on issues related to the use of certain payment methods and methods. However, the User hereby acknowledges and agrees that Fobos 17 is generally unable to provide the User with comprehensive explanations regarding the use of certain payment systems and methods. For questions regarding the refund of erroneously paid funds or funds paid by the User in violation of the rules established by their chosen payment systems or methods, as well as relevant legislation, the User must contact the relevant operators of the payment systems and methods directly.

If the User plays the Game on third-party platforms, such as Apple iOS or Google Android, they are obligated to comply with all rules established by these platforms. Payment procedures and methods in such cases are governed by the platform's rules. Fobos 17 is not responsible for the actions of these platforms.

10.6. Consequences of Unlawful Payment Actions. The User hereby confirms that they have the right to use their chosen payment methods and/or payment methods to access Additional Features, without violating the rights of third parties and/or the laws of the country in which the Game is used and/or the payment is made.

The User undertakes to compensate Fobos 17, other users of the Game and other third parties for all losses incurred by them in connection with the User’s unlawful conduct, including in connection with the use of funds not belonging to the User to pay for access to Additional Features.

Unless otherwise provided by this Agreement or applicable law, Fobos 17 reserves the right to unilaterally suspend or completely terminate the User's access to the Game and/or Additional Features if there is a suspicion of the User committing unlawful acts related to payment for Additional Features. In this case, Fobos 17 is not obligated to pay such User any compensation, including monetary compensation, unless otherwise provided by this Agreement or applicable law.

If Fobos 17 has reason to believe that the User is committing illegal actions related to payment for access to Additional Game Features, Fobos 17 has the right to transfer the relevant information to law enforcement agencies for an investigation into this fact.

10.7. Inadmissibility of acquiring rights from third parties. Fobos 17 holds the exclusive right to provide access to the Game and/or Additional Game Features. Therefore, no offers from third parties (except for persons authorized by Fobos 17) to grant rights to use the Game and/or Additional Game Features should be considered by the User as offers from Fobos 17.

The User is obligated to immediately notify Fobos 17 of any known instances of access to Additional Features or of the User receiving offers to pay for Additional Features from persons not affiliated with or not authorized by Fobos 17. This obligation extends to advertisements and offers posted online, with the exception of offers posted on Game Resources.

If the User, in violation of this Agreement, has paid for access to Additional Features to persons not related to or authorized by Fobos 17, the User’s claims will not be accepted, and Fobos 17 will not compensate the funds spent by the User under such circumstances, nor will it provide access to Additional Features.

If Fobos 17 determines that the User is accessing the Additional Features of the Game from third parties not affiliated with or authorized by Fobos 17, Fobos 17 has the right, at its sole discretion, to suspend, restrict, or terminate the User's use of the Game and/or Additional Features.

Obtaining access to Additional Game Features from third parties not affiliated with or authorized by Fobos 17 does not relieve the User of their obligation to comply with this Agreement and the Key Documents, nor does it exempt them from any measures specified in this Agreement or the Key Documents. In such cases, the User will not be reimbursed for the purchased access rights to Additional Game Features.

10.8. Account Monitoring . The User is obligated to independently monitor the status of the Account they have created to determine whether they have purchased Additional Features.

10.9. Termination of Access to Additional Features . The User understands that during the gameplay, access to Additional Features to the extent of the rights acquired thereto may be terminated by Fobos 17 in accordance with this Agreement (as a result of their consumption; exchange for other Additional Features or Game Elements, if provided for by the Game's functionality and permitted during the gameplay; expiration of access to Additional Features; suspension or termination of access to the Game under the terms of this Agreement, etc.) or for other reasons, and this does not give the User grounds to demand reimbursement from Fobos 17 for the cost of acquired access rights to Additional Features of the Game, except in cases provided for by this Agreement and the law.

If, as a result of a technical error, a Game malfunction, or the User's deliberate actions, they have accessed Additional Features of the Game without paying compensation in accordance with the procedure established by this Agreement, the User undertakes to notify Fobos 17 and pay Fobos 17 the cost of such Additional Features, if they were used by the User. Fobos 17 reserves the right to rectify such consequences independently, without notifying the User and without any compensation from Fobos 17, including deleting such Additional Features from the Account created by the User.

10.10. Exchange . Fobos 17 does not exchange Additional Features and/or Game Elements for other Additional Features and/or Game Elements, or for cash or non-cash funds, unless otherwise expressly permitted by the Game Rules.

10.11. Reimbursement of Expenses . Fobos 17 does not reimburse the User for expenses associated with the User's acquisition of access rights to Additional Game Features, except in cases expressly provided for by this Agreement or applicable law.

 

11. INTELLECTUAL RIGHTS

11.1. Exclusive Rights to the Game . The Game, including its source and object code, graphics, gameplay, user interface, any game elements, musical accompaniment, and other content, constitute and/or contain intellectual property, the exclusive rights to which belong to their legal owners.

The User agrees that any element of the Game, including Additional Game Features, is an integral part of the Game as a computer program and is protected by law. Although the User is granted access to the Game and Additional Game Features, playing the Game and participating in the Game cannot be construed as a transfer and/or assignment of exclusive rights to the Game or any of its parts, including Additional Game Features, from Fobos 17 to the User.

The User agrees and fully acknowledges that all exclusive rights to the localized (translated into the appropriate language) Game, including Additional Features, graphic images, photographs, animations, video images, video clips, sound recordings, sound effects, music, text content and content of the Game, as well as any other elements of the Game without exception, belong to their legal copyright holders.

11.2. Exclusive Rights of the User. Copyright to materials posted in the Game by the User belongs to the User who created them or other legal rights holders (hereinafter referred to as " Materials ").

11.3. License to Materials . The rights to perpetual, free use of Materials that are objects of intellectual property are transferred to Fobos 17 in the form of a non-exclusive license throughout the world from the moment the User posts (publishes) these Materials in the Game, without any reciprocal obligation to pay copyright or other remuneration and without limitation on the term, method, or territory of use. The rights to use the Materials under this clause include the right to use them in any way and in any country, including disclosing, distributing, modifying, adapting, otherwise processing, publishing, and creating derivative works without the obligation to mention the author's name or other reciprocal obligations. The User undertakes to provide the legal basis for granting Fobos 17 intellectual property rights to Materials posted by the User in the Game and owned by other copyright holders.

11.4. Restrictions. Any use of intellectual property objects or parts thereof contained in the Game without the prior written permission of Fobos 17 is strictly prohibited, except as otherwise provided in this Agreement.

11.5. Trademarks . The trademarks "World of Fishers ," " wof . fish, " and "Fobos 17" are registered and protected in various jurisdictions worldwide. Third-party trademarks mentioned in the Game or its description belong to their respective owners.

 

12. TERM, MODIFICATION AND TERMINATION OF THE AGREEMENT

12.1. Term of the Agreement . This Agreement shall enter into force upon acceptance of its terms by the User and shall be valid for twelve (12) months. This Agreement shall be automatically extended for an additional six (6) months unless terminated by one Party by sending written notice to the other Party at least thirty (30) calendar days prior to the expiration of the Agreement. In the event of termination of the Agreement in the manner specified, Fobos 17 will not refund the User's funds or compensate for any losses.

12.2. Amendments to the Agreement. This Agreement may be amended unilaterally by Fobos 17. Notice of amendments to the Agreement will be published on the Game's website and/or sent to the User for review via the email address specified when creating the Account, no less than ten (10) calendar days prior to the amendments taking effect.

Use of the Game or authorization in the Game following the publication of an announcement and/or notification of changes to the Agreement in the manner specified above constitutes the User's consent to the changes made to the Agreement. The User is not released from the obligations stipulated by this Agreement, taking into account the changes made thereto, if the User has not read the changes to the Agreement.

12.3. User's Disagreement with Changes to the Agreement . The User may not use the Game if they do not agree with the changes made to the Agreement.

In this case, the User has the right to terminate the Agreement unilaterally within ten (10) calendar days of posting the changes to the Agreement on the website and/or sending an email notification. If a decision is made to terminate this Agreement, the User is obligated to send Fobos 17 a notice of termination via email. If the User fails to express a desire to terminate this Agreement within the aforementioned ten (10) calendar day period, the User is deemed to have accepted the terms of this Agreement, taking into account the changes made thereto.

Upon receipt of the User's termination notice, Fobos 17 will suspend the User's access to the Account. Fobos 17 will not provide any refunds or other compensation, including for any damages.

12.4. Termination of the Agreement by Fobos 17. Fobos 17 reserves the right to terminate this Agreement unilaterally and extrajudicially at any time, terminating access to and the ability to use the Game and/or Additional Features in the following cases:

12.4.1. In the event of Game closure. In this case, Fobos 17 is obligated to send the User a corresponding notice at least thirty (30) calendar days prior to the Game closure date and/or publish it on the Game's website. In this case, Fobos 17 will not pay any compensation and, among other things, will not reimburse the User for the monetary equivalent of in-game currency, premium gear, premium account, etc.

12.4.2. In the event of any violation by the User of the terms of this Agreement or the Key Documents, as well as the terms of use of other Fobos 17 games, including a single violation. In this case, Fobos 17 will not refund the User's funds or compensate for any losses.

12.5. Termination of the Agreement by the User. The User has the right to unilaterally and extrajudicially terminate this Agreement at any time, without notice to Fobos 17 or explanation, by deleting their Account, while preserving the User's obligations and liabilities that arose prior to deletion. In this case, all Additional Features and Game Elements linked to this Account will be deleted without the right to restore them. In this case, Fobos 17 is not obligated to pay the User any compensation.

12.6. Changes to Key Documents . The User acknowledges that Fobos 17 has the unconditional right to unilaterally change the terms of the Key Documents and that such changes do not constitute changes to this Agreement.

 

13. FINAL PROVISIONS

13.1. Invalidity . If one or more provisions of this Agreement are declared invalid in accordance with the established procedure by a final and binding court decision, the remaining provisions of this Agreement shall remain in force and the Parties shall continue to fulfill their obligations in a manner that best corresponds to the intentions of the Parties at the time of conclusion and/or amendment of this Agreement.

13.2. Dispute Resolution . All disputes between the parties under this agreement shall be resolved through correspondence and negotiations using the mandatory pre-trial (claims) procedure. If the parties are unable to reach agreement through negotiations within sixty (60) calendar days of the other party's receipt of a written claim, the dispute may be referred by either interested party to the court at the place of registration of Fobos 17 (excluding the jurisdiction of any other courts) in accordance with the procedural and substantive laws of the state of registration of Fobos 17, excluding conflict of laws rules.
